Forget me not: the human right to legal capacity of persons with dementia

PhD candidate Fiore Schuthof has written an article for the European Human Rights Law Review. The article examines the approaches of the UN Convention on the Rights of Persons with Disabilities (UN CRPD) and the European Court of Human Rights (ECtHR) to the right to legal capacity of people with dementia. It discusses the specific challenges that this group may face in terms of their decision-making capacity, such as the changing nature of their condition and the changing wishes and preferences that this may entail.
